According to the common opinion, gold and silver, whether in the form of bars or in the form of coins like dirhams and dinars, are considered “مثلي” (fungible). Therefore, if they are seized or lost, the equivalent must be paid. Many scholars have ruled that the gold in jewelry is also treated as “مثلي,” and the cost of its construction should be paid at its current value. Thus, the person who has seized or lost it must repay the weight of the lost gold and the cost of its construction to the owner. Some scholars have considered the price to be the determining factor, while others suggest that the loss of crafted gold should be repaid with an equivalent in weight and craftsmanship. Therefore, it must be returned to the owner in equivalent form, both in weight and craftsmanship.
